Terms of use


Welcome to Bytehealthy. This Terms of useis an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures. This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or use of Bytehealthy application for mobile and handheld gadgets by any user.

For the purpose of this Terms of Use, wherever the context so requires "You" or "User" shall mean any natural or legal person who has agreed to become a Customer on Platform by providing data while registering on the Platform as Registered User. The term "Bytehealthy", "We", "Us", "Our", “Platform” shall mean (Bytehealthy) and its affiliates.

This Terms of Use are effective for all existing and future Bytehealthy users, including but without limitation to third parties, Kitchens, Customers, etc.

Your use of the Bytehealthy and services and tools are governed by the following terms and conditions ("Terms of Use") as applicable to the Bytehealthy including the applicable policies which are incorporated herein by way of reference. By mere use of the Bytehealthy, you shall be contracting with Bytehealthy, who is the owner of the Platform. This terms of use including the policies constitute your binding obligations, with Bytehealthy.


1.Definitions:

A:-“Platform” means the Byte Healthy software platform developed on the Android, the iOS, the Windows, the MacOS platform, and a website where Kitchen Owner offers food and beverages for sale and Customers can order and purchase food offered by the Kitchen Owner.
B:-“Beverages” means all beverages, whether made by the Kitchen Owner or not, which is fit for human consumption.
C:-“Cash on Delivery” means payment received from the Customers in cash, including payments made using credit or debit cards, at the time of delivery of the Food.
D:-“Customer” or "You" means any person who orders food and beverages using the Byte Healthy Platform or Application.
E:-“Delivery Partner” means an individual/firm/company who collects food and beverages from the Kitchen Owner and delivers the food and beverages to the Customer.
F:-“Delivery Person” means the person employed by the Delivery Partner or the Kitchen Owner, as the case may be, for collection and delivery of Food Products from Kitchen Owner to Customers.
G:-“Food” means all food items offered by the Kitchen Owner and includes prepared foods, snacks, baked goods, pickles, papad, sweets, delicacies, home-made beverages, cuisines, festival special, in-house grown vegetables, fruits, exclusive pre packed goods.
H:-“Intellectual Property Rights” means all intellectual property rights, including but not limited to rights to patents, rights in circuit layouts, trademarks, service marks, trade names, registered designs, copyrights, and other forms of intellectual property or industrial property, know-how, inventions, formulae, confidential or secret processes, trade secrets and confidential information, and any other protected rights and assets and any licenses and permissions in connection therewith, in each case in any part of the world and whether or not registered or registrable and for the full period thereof, and all extensions and renewals thereof, and all applications for registration in connection with the foregoing.
I:-“Kitchen Owner” means the Party who offers food and beverages for sale on the Byte Healthy Application.
J:- “Kitchen” means any place which is used by the Kitchen Owner to prepare food and beverages.
K:-“Packaging Material” means all materials, including, boxes, bags and tapes which are used to pack the food.
L:-“Price” means offer price for the Food, which is displayed in the Application, as determined by the Kitchen Owner.
M:-"Menu" means any document circulated or virtual page displayed in Byte Healthy Application, which lists out the Kitchen Owner’s Food Products offered for sale to the Customer.
N:- "Order" means the placement of an order by Customers with the Kitchen Owner for the purchase of Food Products via the Application.
O:-"Order Value" means the amount which is payable by the Application User upon placement of an Order with the Kitchen Owner via Byte Healthy Application for the Food Products.
P:-“On-Line Payment” means payment made by Customers on the Application at the time of ordering, which includes, payments made using credit or debit cards, UPI, wallets or net banking.
Q:- "Services" means the following services offered by Byte Healthy Application to the Kitchen Owner, on and from the Effective Date, for the provision of sale of Food Products to the Application User via Byte Healthy Application and simultaneously business generated by Delivery Partner vide logistic supply chain and includes:
a:- listing of the Menu and the price list supplied by the Kitchen owner in respect of the Food Products on the Byte Healthy Application;
b:- Order placement mechanism for the purchase of Food Products by the Application User from the Kitchen Owner on a real time basis;
c:- payment mechanism for the payment of the Order Value by the Application Users; and
d:-Application User’s complaint redressal services in respect of preparation and delivery of Food Products.
e:-Logistics Services by Delivery Partner.
R:- “Storage area” means the place where ingredients and raw materials for preparation of food is stored. When you use any of the services provided by us through the Platform, including but not limited to, (e.g. browsing profiles and menus of home kitchens, ordering home kitchen food, writing reviews,, rating system, payment processing, etc.), You will be subject to the rules, guidelines, policies, terms, and conditions applicable to such service, and they shall be deemed to be incorporated into this Terms of Use and shall be considered as part and parcel of this Terms of Use. We reserve the right, at our sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time without any prior written notice to you. You shall ensure to review these Terms of Use periodically for updates/changes. Your continued use of the Platform following the posting of changes will mean that you accept and agree to the revisions. As long as you comply with these Terms of Use, we grant You a personal, non-exclusive, non-transferable, limited privilege to enter and use the Platform. By impliedly or expressly accepting these Terms of Use, you also accept and agree to be bound by Bytehealthy Policies including but not limited to Privacy Policy and Cookie Policy as amended from time to time.

2. User Account, Password, and Security:

If you use the Platform, you shall be solely responsible for maintaining the confidentiality of your login username, password and physical address; and only you shall be responsible for all activities that occur under your username and password. You agree that if you provide any information that is untrue, inaccurate, not current or incomplete, we shall have the right to indefinitely suspend or terminate or block access of your membership on the Platform.

3.Services Offered:

Bytehealthy provides customers with “GHAR KA KHANA”. Our Bytehealthy Application and Platform enables users to order “GHAR KA KHANA” which means homemade food that is available near your regions/neighbourhood, theseis homemade foods will be delivered directly by us to you on your login address within a specific period of time. The food can be ordered through the Platform through various methods of payments offered by Bytehealthy. The order/delivery of food items shall be additionally governed by specific policies including but not limited to cancellation policy, refund policy, etc. Bytehealthy does not warrant that food description or other content on the Platform is accurate, complete, reliable, current, or error-free and assumes no liability in this regard. Bytehealthy simply provides a Platform to help home kitchens and Users/Customers to connect with each other efficiently and process orders.

Third Party Content Severability
If any of these Terms of Use should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these Terms of Use are intended to be effective, then to the extent and within the jurisdiction where that term is illegal, invalid or unenforceable, it shall be severed and deleted and the remaining Terms of Use shall survive, remain in full force and effect and continue to be binding and enforceable. You shall not assign or transfer or purport to assign or transfer the contract between you and us to any other person. Governing law and dispute resolution
These Terms of Use are governed by the laws of India. Any action, suit, or another legal proceeding, which is commenced to resolve any matter arising under or relating to this Platform, shall be subject to the jurisdiction of the courts at Ranchi, Jharkhand, India. IP Notice and Take Down Policy->
  • Bytehealthy has put in place IP Notice and Take Down Policy (“Take Down Policy”) so that intellectual property owners could easily report listings that infringe their right to ensure that infringing products are removed from the site, as they erode Customer and good Seller trust.
  • Only the intellectual property rights owner can report potentially infringing products or listings through Take Down Policy by way of Notice of infringement in the specified format. If you are not the intellectual property rights owner, you can still help by getting in touch with the rights owner and encouraging them to contact us.
(Note: Bytehealthy does not and cannot verify that Kitchens have the right or ability to sell or distribute their listed products. However, Bytehealthy is committed to ensure that item listings do not infringe upon intellectual property rights of third parties once an authorized representative of the rights owner properly reports them to Bytehealthy.)
